FY2019 H-1B Cap-Subject Petitions Still Pending with the CSC

Some FY2019 H-1B cap-subject petitions remain pending with the USCIS California Service Center (CSC) and may not have received an initial “touch” (Request for Evidence or Notice of Intent to Deny). USCIS has acknowledged the FY2019 cases remain pending and has indicated that it is unable to provide a timeframe for initial review of such cases. These petitions were received by USCIS and accepted for processing during the April 1, 2018 filing window. USCIS currently indicates processing times of between 8.5 and 11 months for H-1B cap-subject petitions pending with the CSC.
