When the Affordable Care Act was enacted in 2010, employers hoped that a clear path would be revealed by the time the employer mandate came into play. However, just the opposite has occurred—the complexity of the Affordable Care Act has increased over time. Even the seemingly simple question of which employers are subject to the employer mandate is a moving target. Some employers are subject to the employer mandate in 2015 and others not until 2016 (and for the lucky smaller employers, not at all).
