The landscape for developing battery energy storage facilities (BESS) in Massachusetts is evolving rapidly. The Commonwealth determined that storage capacity will need to exceed 5.8 GWs by 2050 to ensure a reduction in power sector emissions. State regulators have recently issued the first orders allowing the construction and operation of BESS facilities in the Commonwealth despite zoning restrictions. Legislation is being drafted that would permit, under certain circumstances, the certification to construct BESS facilities in the state.
On October 11, 2023, Pierce Atwood energy storage attorneys Andrew Kaplan, Dan Bailey, and Rick Novak, who counsel clients in the siting, real estate, land use, and zoning of BESS facilities, will be joined by Paul Rogers, co-founder of the Energy Safety Response Group, to discuss the development of such facilities in Massachusetts in light of these developments and how applicable national testing procedures for BESS facilities should reassure residents and regulators that they can be constructed and operated safely.
