Federal and state (and sometimes even local) laws provide significant protection for employees who can’t come to work – or who need job modifications – for medical reasons. But, these laws are complicated and it can be difficult for employers to figure out how to meet these legal obligations and still get the work done. This seminar will go beyond the forms, focusing instead on the challenging real-world issues that HR professionals increasingly face.
In addition to a brief overview of the FMLA and ADA, we will explore practical solutions to the following important issues:
- The overlap of FMLA and state leaves
- The challenge of intermittent and reduced schedule leave
- Long-term leave
- Reasonable accommodations under the ADA
- Managing the interactive process
- The FMLA and ADA: working together?
- Employees returning from leave with work restrictions
- Managing performance when an employee has a medical condition
