Pierce Atwood partner Brooks Magratten joined this ABA panel discussing the recovery of attorneys' fees in ERISA litigation and when fees are available to a litigant.
Topics included the awards of attorney's fees when a case is remanded for further review by the plan administrator in litigation, fee awards to prevailing defendants in ERISA litigation, as well as recent trends regarding the determination of what constitutes a reasonable attorney's fee in single plaintiff ERISA benefits litigation. Also discussed was the impact of forced mediation and arbitration on attorney's fees in ERISA claims.
