Chris Whitney to Present on Recent Project Labor Agreement Victory at Associated Builders and Contractors of Rhode Island Member Meeting

For more than 20 years, Pierce Atwood construction and litigation partner Chris Whitney has represented the merit shop (non-union) side of the construction industry, opposing efforts of the construction building trades union to restrict the right of merit shop contractors to compete for, and win, public construction projects in Massachusetts and Rhode Island, through the imposition of union-only Project Labor Agreements (PLA), also known as “Responsible Employer Ordinances.”

On behalf of trade associations representing merit shop contractors, and some of their member companies, we filed suit in Hampden County Superior Court to enjoin the imposition of the PLA. In a strong and clear decision, the court issued an injunction preventing the Springfield Water and Sewer Commission from imposing a union-only PLA on the construction of the West Parish Water Treatment Plant.
