Don Pinto Quoted in Massachusetts Lawyers Weekly: Abutters Can’t Block Private School Construction
In a case involving a 50-foot-wide easement that connected a cul-de-sac to a site the owners planned to develop for a private school, Pierce Atwood real estate and land use litigation partner Donald R. Pinto, Jr. noted that he thought that “this was the first appellate decision to cite the Dover Amendment in interpreting the scope of an easement.”
Don added that he “expects the decision to be frequently cited in disputes over the scope of easements, even when the proposed use is not one that is exempt from zoning under the statute in which the Dover Amendment appears.”
