Pierce Atwood T&E Attorneys Presenters at Maine State Bar Association Elder Law and Estate Planning Institute
Pierce Atwood Trusts & Estates attorneys Molly Liddell, Barbara Wheaton, and Griff Leschefske will participate in a two-day program sponsored by the Maine State Bar Association's Elder Law and Trusts & Estates Sections.
Molly Liddell, Chair of Pierce Atwood’s Trusts & Estates Practice Group, will present on “Fiduciary Liability,” discussing the fiduciary duties of executors in administering the estate according to the terms of the decedent’s will. This includes gathering and valuing the assets of the estate, paying debts and taxes, and distributing the remaining assets according to the terms of the will.
Trusts & Estates partner Barbara Wheaton will participate in a panel discussion on “Ethics in Client Representation,” where panelists will discuss the crucial requirement of ethical conduct in client representation and practice management, including maintaining client confidentiality, avoiding conflicts of interest, and ensuring competence, honest, and integrity in all interactions.
Firm T&E partner Griff Leschefske will present the session, “Good Trustee Selection and Succession: A Discussion of Technical Issues and Strategies.” This program will include approaches to common challenges, including the use of independent trustees vs. family member trustees, trustee appointment and removal, grantor trust income tax considerations, estate tax problems, judicial and non-judicial trustee succession, directed trustees, trust protectors, and advanced state income planning tax strategies tied to trustee selection.
